Factor Funding Market operates as a funding marketplace / referral service that helps businesses compare and connect with third-party funding providers. We are not a bank or direct lender unless expressly stated. Nothing on this site is an offer or commitment to lend, and using the site or booking a call does not constitute an application for credit.

3. No guarantee of approval or terms

All financing is subject to provider underwriting and approval. Rates, fees, amounts, repayment structures, and timelines are determined by the funding provider, vary by applicant, and are not guaranteed. Meeting any stated minimum criteria does not guarantee approval, and some industries or states may be restricted.

4. Eligibility

You represent that you are at least 18 years old, are authorized to act on behalf of the business you inquire about, and that the information you provide is accurate.

5. Information you provide

You are responsible for the accuracy of information you submit. We handle information as described in our Privacy Policy.

6. Third-party links & providers

The site may link to or rely on third parties, including scheduling tools and third-party funding providers. We do not control and are not responsible for their content, products, services, or privacy and data practices, and your dealings with them — including any application, agreement, rates, or funding — are solely between you and that third party. Any funding decision, offer, and final terms come from the provider, not from us. Before proceeding with a third party, review their own terms and privacy policy, which govern your relationship with them.

The site and information are provided “as is” without warranties of any kind to the extent permitted by law. We do not warrant that the site will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Factor Funding Market and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the site or your dealings with any third-party funding provider, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Governing law & disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

If a dispute arises, please contact us first at support@factorfundingmarket.com so we can try to resolve it informally; most issues can be settled this way. If we can’t resolve it within 30 days, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site will be brought exclusively in the state or federal courts located in New York County, New York, and you and we consent to the personal jurisdiction and venue of those courts. Each party is responsible for its own costs and fees unless a law or court order provides otherwise.

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.
